As anticipation builds for the U.S. Securities and Exchange Commission (SEC) to approve the first Spot Bitcoin ETF during the critical window of January 8th to 10th, signs point to the final steps being underway. Leading issuers like Fidelity, Grayscale, Ark Invest/21 Shares, Valkyrie, and VanEck have submitted the Form 8-A for security registration with the SEC. Bitwise took the lead by submitting its Form 8-A last Friday.

The Final Hurdle: SEC Approval Still Pending
The submission of Form 8-A, necessary for ETFs to list their products as securities on exchanges, marks a significant step forward. However, Bloomberg ETF analyst James Seyffart cautions that this submission is for registration purposes and does not imply SEC approval. The ETFs still require approval of Form 19b-4, addressing rule changes for trading, and a complete, approved S-1 filing.
Bloomberg Analysts Weigh In
James Seyffart expects potential SEC approval next week, while fellow Bloomberg analyst Eric Balchunas reveals that the SEC is providing final feedback on Spot Bitcoin ETFs, with issuers soon to submit final 19b-4 and S-1 forms. He stresses that, while close to “completion,” official approval is yet to be announced.
SEC Addressing Remaining Concerns
The Block’s sources suggest the SEC is resolving outstanding issues in communication with applicants, including the creation/redemption mechanism, Authorized Participants, and handling Bitcoin forks.

Fox News: SEC Approval as Early as Friday?
Fox News reports insider claims that the SEC might approve a Spot Bitcoin ETF as soon as this Friday, with trading commencing next week. Seyffart, however, expects no approval on January 5th, looking towards January 8th to 10th instead.
